The defense tried to get the hold-out dismissed and the jury foreperson complained s/he was not properly applying the concept of reasonable doubt. The judge tried a couple of times to get them to go back and sort it out, before finally declaring a mistrial.

MAIL IN BALLOTS: U.S. District Judge Indira Talwani of Massachusetts has issued a preliminary injunction to halt the USPS from implementing rules that required state and local election officials to submit outbound and return mail envelopes for USPS design review, place unique tracking barcodes on those envelopes, and upload voter names, addresses, and barcode data to a new federal portal. Mailings that do not match portal data or that fall short of the envelope standards would not be accepted for delivery.
Talwani held in her new ruling that the challengers were likely to succeed in their lawsuit, that the USPS lacked authority to enforce the rule, and that, as election officials have said, given existing time constraints, complying with the rule for the midterms was “likely impossible.”
MILITARY: Back in 2009, U.S. Army soldier Bowe Bergdahl, then 23, walked off his base during a deployment to Afghanistan in 2009 and was subsequently captured by the Taliban. Then-President Barack Obama negotiated Bergdahl’s release in a 2014 prisoner swap.
In 2017, Bergdahl pleaded guilty to desertion and misbehavior before the enemy, after which he was dishonorably discharged and ordered to forfeit $10,000 in pay. Around three years ago, a civilian judge vacated Bergdahl’s court-martial conviction.
On Tuesday, a three-judge panel on the D.C. Circuit overturned that ruling, because district courts lack jurisdiction in court-martial judgments.
