The Law Newz article linked above contains an interesting analysis of two, diametrically opposed judgments renders on the same day re: Trump’s immigration order. I have no law background, but found the reasoning easy to understand.
Conclusion: “Second-guessing Trump’s decision is for elections, not judges. The Supreme Court long ago rejected such second-guessing as impermissible. The Boston’s judge’s thoughtful and deliberate decision follows the precedents, as the law compels. The Seattle judge’s decision tries to substitute for the legislative branches, which the law condemns. This article recounts the history of election year SCOTUS nominations and shows that there is no history of delaying them until after the election. I dunno where that idea came from, nor do I understand how the last Senate managed to delay until Trump was in office. As a conservative pro-lifer, I’m glad they did, since Obama’s nominee replacing Scalia would’ve tipped the court to the Left.
