Minority Leader Chuck Schumer and the Democrats are stalling confirmation of not just Trump’s top cabinet picks, but also his choices for the 1,987 vacancies further down the food chain within the administration.

Their underlying goal is to allow remaining Obama-appointed bureaucrats to do as much damage to the Trump administration as they can before leaving.

The Myth of the Stolen Supreme Court Seat

The myth of the “stolen seat” stems from the GOP-majority Senate’s refusal to vote last year on President Obama’s nominee to fill Antonin Scalia’s seat.  

But the standard of not confirming a Supreme Court nominee in the final year of a presidency was set by two prominent Democrat leaders, Joe Biden and Chuck Schumer.

Does anyone honestly think that, had the roles been reversed in 2016, and a Democrat-majority Senate faced a Republican lame duck president’s nominee, Sen. Harry Reid would have held a confirmation vote?

Be Careful What You Wish For

One thing is clear. If the miserable slug from Nevada had not undone the filibuster in his zeal to get rafts of Obama judicial nominees, President Trump would not have a single cabinet member confirmed. Not a one.

  • Education Secretary: Betsy DeVos confirmed on a voted 51-50.
  • Attorney General: Jeff Sessions confirmed 52-47.
  • HHS Secretary: Tom Price confirmed 52-47.

To the surprise of absolutely no one, the injunction against the travel ban was upheld by the ninth circuit by a margin of 3-0.

Sessions had not yet been confirmed and the lawyers from the Justice Department who argued the case were holdovers from the Obama regime, so there was no real motivation to put much effort in their argument.

It is paramount that the Republicans get Neil Gorsuch confirmed to SCOTUS before the case is heard there. With a 4-4 split, if Kennedy sides with the originalists in deciding such action is within the purview of presidential power, the lower court ruling would stand. It will eventually be reinstated, but the when is unknown.

The Senate confirmed Rex Tillerson as Secretary of State with 56 votes; Jeff Sessions as Attorney General with 52 votes; and Betsy DeVos, who barely reached a majority of 51 votes without Vice President Mike Pence’s deciding vote to confirm her as Secretary of Education.

“As we look back, it may well have been better to not have changed the rules.”

Some Democrats remain unapologetic about the decision, however. Sen. Tim Kaine (D-Va.) told IJR he maintains that filibuster reform was essential:

“At the time I thought, ‘I might serve here with a Republican president and I might serve here when there’s a Republican majority.’  We were in a situation where positions that were really important were going vacant for years at a time.”

Moments after the ruling, Trump tweeted, “SEE YOU IN COURT,” adding that “THE SECURITY OF OUR NATION IS AT STAKE!”

In response, Washington Gov. Jay Inslee, a Democrat who leads one of the states that challenged the ban, said: “Mr. President, we just saw you in court, and we beat you.”

The court battle is far from over. An appeal to the U.S. Supreme Court seems likely. That could put the decision in the hands of a divided court that has a vacancy.

Trump’s nominee, Neil Gorsuch, is unlikely to be confirmed in time to take part in any consideration of the ban, which was set to expire in 90 days unless it is changed.

Senate Democrats flew a restaurant worker all the way from Los Angeles to Washington on Thursday, to help them portray President Trump’s nominee for Labor Secretary not only as “unqualified,” but also as someone who steals money from workers; looks the other way when workers are sexually harassed; forces people to work for free; punishes them for calling in sick; and fights against raising the minimum wage.

“Puzder called us the worst of the worst and the bottom of the pool. I work myself to the bone just to survive. Why would we want someone who think so little of workers in charge of policies that could impact all of us?” the allegedly victimized woman asked.

On Thursday, Schumer told the same news conference, “It’s disgraceful to put ‘secretary of labor’ and ‘Puzder’ in the same sentence, given his views.”

Schumer said Democrats hope they can force the withdrawal of Puzder’s nomination, but even if they can’t, it’s all about laying the groundwork to stymie the Trump administration:

Liberal Ninth Circuit Court Is Overturned in Recent Years 80% of Time

The Ninth Circuit Court ruled against President Trump and continued to block his travel ban on Thursday.  The Ninth Circuit is the most liberal court in the country — and is the most reversed court in the country.

2010, perhaps seeking to reclaim its position at the top of the heap, the Ninth Circuit was reversed a startling 19 times (79 percent), three times as many reversals as most circuits had cases before the Supreme Court. The same pattern continued in the 2011 (71 percent) and 2012 terms (86 percent), when the Ninth Circuit was reversed more than twice as many times as most circuits had cases before the Court.

Betsy DeVos confirmed as Trump’s Secretary of Education

As expected, the vote was 50-50, triggering the remedy provided for in the Constitution, which is for the Vice President to break the tie.

Sen Chuck Schumer (D-NY) played his role in the on-going Democrats in La-La Land farce by tweeting:

That’s definitely not ridiculous or anything.

  1. It’s not his cabinet. It’s President Trump’s.
  2. It’s not “rigged” to follow the procedures set out in the Constitution.
  3. It’s not “rigged” for the VP to vote for the person he wants.

Senator Schumer, you make me ashamed to be among your constituents.

The Self-Beclowning Continues

It is an unfortunate state of affairs that the alt-left is so consumed with obstructing progress that they fail to see that, for all but those who suffer similar dementia, they look like a bunch of braying jackasses raising a racket and crapping on the floor of the building where they have to ‘work’, or some similar facsimile.

They are, at the time of this posting, in the middle of a 24 hour conniption fit, trying to convince one more RINO to join them in doing the teachers union’s bidding. They already have Murkowski from Alaska and the Maine Pain Susan Collins. That makes the vote 50-50, with Vice President Pence tasked with casting the tie-breaking vote on a cabinet nominee for the first time in history. The end game is to delay seating the president’s cabinet as long as possible, just for pure meanness.

Trump’s travel ban to be argued Tuesday in S.F. federal court

Robart said the states had shown that the travel ban was causing financial hardship to their residents and to institutions such as state universities, and were likely to prove that Trump’s order discriminated against Muslims.

While Trump responded with tweets about the “so-called judge” and his “ridiculous” ruling, Justice Department lawyers argued that Robart had harmed the nation with “judicial second-guessing of the president’s national security determination.”

Activists have targeted those Republicans who they believe have reservations about DeVos, particularly those from rural states, where alternatives to public schools — such as those promoted by DeVos — are few and far between. But other than Murkowski and Collins, no Republican has indicated that their support is shaky.

What’s really behind Democrats’ all-night anti-DeVos show

Again, the only real issue here is her ardent support for school choice, including public charter schools and voucher programs to help families choose qualified private or parochial schools for their kids. The unions (rightly) see choice as a potentially fatal threat to their vast power.

The all-nighter is also a bit of virtue-signaling to the Dems’ angry base that they’re really, really trying to Stop Trump At All Costs. (Maybe this will end the noisy rallies outside Chuck Schumer’s house?)

The Senate is scheduled to continue confirming Trump’s Cabinet nominees this week, with a vote scheduled for Tuesday to approve Betsy DeVos, nominated to run the Education Department. Senators are poised to confirm Sen. Jeff Sessions (R-Ala.) to serve as the next attorney general by the end of the week.

But those votes are expected to happen with little or no Democratic support.  Only Sen. Joe Manchin III (D-W.Va.) has announced plans to support Sessions. As of Monday, no Democrat has announced support for DeVos, Rep. Tom Price (R-Ga.), nominated to lead Health and Human Services, or Steven T. Mnuchin, nominated as treasury secretary. They all are scheduled for up-or-down votes in the coming days.
