PROOF! Not a “smidgen” of corruption at the IRS!

On September 4, 2014, Judicial Watch released a new batch of Internal Revenue Service (IRS) emails obtained through the Freedom of Information Act.

  • These emails prove that the Obama IRS solicited donor lists from non-profit political groups that were neither needed nor used by the agency to determine tax-exempt status. Of the groups from whom donor lists were inappropriately solicited, 75% were politically conservative, while only 5% were politically liberal.
  • These emails show that the purpose for obtaining these lists was a “secret research project” being handled by top level officials in the DC office of the IRS, but do not reveal the nature of that project.

These email PROVE beyond a shadow of a doubt that Lois Lerner and Barack Obama both LIED last winter when they blamed the illegal IRS targeting of conservative political groups on “bonehead decisions in local offices.”

Two emails from Lois Lerner, Obama’s Director of the IRS Exempt Organizations Unit, state clearly that all tax-exempt status decisions had to have the express approval from her D.C. office.

A third email, this one from IRS attorney Michael Seton to Lois Lerner and other senior IRS staffers, detailed the steps required for this process: “Please inform the reviewers and staff in your groups that before issuing any favorable or initial denial rulings on any cases with advocacy issues, the reviewers must notify me and you via e -mail and get our approval. No favorable or initial denial rulings can be issued without your and my approval.”

UPDATE: Lerner’s emails are almost certainly NOT gone forever

The Obama administration has been telling us for MONTHS, sometimes in SWORN TESTIMONY, that IRS emails related to illegal targeting of conservative political groups were accidentally and irretrievably destroyed.

On August 22, 2014, Department of Justice attorneys for the Internal Revenue Service admitted that ALL government computer records are backed up by the federal government in case of a government-wide catastrophe.

Lerner forgot to delete some of her email …

… and it wasn’t pretty. In them, she expressed a deep and personal loathing for the same right-wingers her IRS division targeted for harassment, calling them a**holes and terrorists who would bring the country down.

In the video below, Rep. Gowdy referenced these email during his questioning of a law professor about the need for a Special Counsel to investigate the IRS. This particular professor has previously called the House Majority Leader, Republican John Boehner, an “embarrassing loser.”

What We Know So Far For Sure

  1. Starting in 2010, the most powerful leaders of the Democratic Party — President Obama, Senators Durbin, Schumer and Levin, Representative Elijah Cummings — ran a ceaseless campaign pressuring the IRS to silence Conservative groups.
  2. Lois Lerner, the former head of the exempt organizations division of the IRS doing the actual targeting, was at the epicenter of the effort. When questioned by Congress, Lois Lerner refused to answer questions, claiming she had a Fifth Amendment right to silence. The IRS then claimed they suspended Lerner when, in fact, they had put her on a leave at full pay. Lerner has since taken retirement with a $50,000+ annual pension.
  3. Ten days after receiving the first inquiry from Congress in June 2011, the hard drives of Lois Lerner and a host of people she’d emailed during the previous two years abruptly “crashed” and were quickly destroyed. (Since when does any government agency get around to doing anything quickly, much less something as inane as destroying dead hard drives?)
  4. When Congress demanded all of the internal emails Lerner’s office staff sent between 2009 and 2011, the IRS dragged its feet for three years, then admitted the hard drives had crashed and been destroyed in June 2011 and that, oopsie, their internal backup tapes are toast also, because those get recycled every six months.
  5. According to FedSpending.org, the IRS had a contract with Sonasoft, an email backup service vendor, starting back in 2005. Sonasoft’s motto is “email archiving done right,” and the company lists the IRS as a customer.
  6. The current IRS Commissioner — John Koskinen — told Congress he does not owe the public an apology over the targeting of Conservative groups or the agency’s failure to provide internal emails. He confidently stated that he is “willing to stand on [the agency’s] record.” Before moving to the IRS in 2011, Koskinen was a chairman at Freddie Mac.

Friday, June 20, 2014: IRS Commissioner John Koskinen appeared before Congress again today to answer questions about how his agency somehow or other “lost” all two years of emails of all the key figures in the scandal. They’d like us to believe it was just an unfortunate accident and that the emails are unrecoverable. Yeah, right.

Rep. Paul Ryan (R-WI), angrily told Koskinen. “I don’t believe you. … Nobody believes you.” As Ryan points out, taxpayers are required to keep ALL accounting records for SEVEN YEARS after filing a return, just in case the IRS decides it wants to audit you. But the IRS? Oopsie. We lost 2 years of emails and how dare you suggest we did it on purpose! Please.

I know from personal experience that, by the federal government’s own standards, “The dog ate my homework”, is PROOF POSITIVE that you’re a lying scumbag! When I was fighting to get on disability (which used to be hard), one set of important medical records was unavailable. The doctor had died and his elderly widow couldn’t find my file. The Social Security judge sneered at my excuse and said I was obviously lying.

Another time, we were talking to a guy I went to high school with. He’d become a tax specialist and had interesting stories about tax court. He said he had a client whose records had legitimately been destroyed in a fire. The IRS audited him for back years and determined that minus this evidence that he had had any right to his claimed deductions, he would have to pay the taxes in full, plus fines, interest, and penalties for having “falsely” claimed he had said deductions.
