OBAMACARE You can't keep your plan

The Obamacrats have made it clear they are not going to do the right thing by us and repeal their disaster of a healthcare law. Obama went so far as to say there was NO WAY the law would be repealed as long as he is in office.

That’s not technically true.

  • PPACA (aka, ACA) could be repealed by Congress with a simple majority vote in the House and Senate, though the latter won’t happen with a Democrat majority under Harry Reid running the Senate.
  • If Republicans win the Senate majority next fall, they could pass a law overturning Obamacare.
  • Obama would certainly veto this law, but a presidential veto can be legally overturned by a two-thirds majority vote in Congress.

Keep in mind that “Obamacare” includes not just the ACA, but also the bazillion heinous regulations subsequently inflicted on us by an unelected band of pro-abortion Obamacrats.

OBAMACARE has 2 parts - PPACA and regulations

There are signs of hope!

  • Eleven Republican physicians are running for U.S. Senate on a “Repeal Obamacare” platform.
  • South Carolina and Georgia are moving to outlaw Obamacare within their own borders. Former New Jersey Superior Court Judge Andrew Napolitano says the states do have the power to do that.
  • A legal challenge has targeted the unconstitutional origins of the PPACA itself. SCOTUS ruled that the ACA’s penalty for non-compliance is not a fine, but a tax. The Constitution says tax laws must originate in the House. The PPACA originated in the Senate.

Another avenue open to individuals is to refuse to participate in the exchanges. If a majority of us do so, maybe the damn thing will collapse under the weight of its own pretensions.

March 2010: Patient Protection and Affordable Care Act (PPACA)

PPACA Section 1312(d)(3)(D) (enacted as public law 111-148) requires all members of Congress and congressional staff to get Obamacare.

(D) MEMBERS OF CONGRESS IN THE EXCHANGE-

(i) REQUIREMENT – Notwithstanding any other provision of law, after the effective date of this subtitle, the only health plans that the Federal Government may make available to Members of Congress and congressional staff with respect to their service as a Member of Congress or congressional staff shall be health plans that are:

I) created under this act; or

II) offered through an Exchange established under this Act (or an amendment made by this Act).

July-August 2013: President Obama, Members of Congress and Karen Archuleta – Obama’s appointed head the Office of Personnel Management (OPM) – meet in closed door sessions to discuss the troubling (to them) fact that under Obamacare, they would not only lose their gold-plated healthcare coverage, but they’d also lose the hefty percentage of the premiums that taxpayers kick in as “employer contributions.”

Sept 2013: OPM issued a 17-page document unilaterally overturning Section 1312(d)(3)(D) of the Obamacare LAW, so Members of Congress can stay on their cushy plans-with-benefits and not have to endure the odious high costs and rotten coverage that PPACA is forcing on the rest of us.

Do these people need taxpayers helping out with their premiums? Hmmmmm, let me think.

  • Annual salary for President Barack Obama (D) = $400,000
  • Annual salary for Senate Majority Leader Harry Reid (D-NV) = $174,000
  • Annual salary for House Minority Leader Nancy Pelosi (D-CA): $193,400
  • (These amounts are ONLY their personal salaries. They do not include the additional moneys allocated for staff, travel and other perqs.)

Senator Vitter (R-Louisiana) responded to this OPM law breaking with Senate Bill 1497: “No Exemption for Washington from Obamacare Act.” Co-sponsors of the bill include Ted Cruz, Ted Inhofe, Michael Enzi, Ron Johnson, Dean Heller, Lindsey Graham, and Mike Lee.

  • In order for this legislation to be brought to the floor of the Senate, it must be approved by the Senate Majority Leader.
  • The current Senate Majority Leader is Senator Harry Reid (D-Nevada) who routinely blocks any bill presented by Republicans, even if they’ve been passed in the House by a bi-partisan majority and are popular with the people.
  • Senator Reid has refused to allow Vitter’s bill to even be DISCUSSED by the Senate, never mind brought to a vote. As long as the Democrats hold a majority of the seats in the Senate, this situation will not change.

Prohibition: Law of the land for 14 years

1919: The requisite number of State legislatures ratified the Eighteenth Amendment to the United States Constitution, enabling national Prohibition to become the law of the land.

Supporters of Prohibition believed banning alcoholic beverages would reduce or even eliminate many social problems, particularly drunkenness, crime, mental illness, and poverty.

1925: Journalist H.L. Mencken noted that five years of Prohibition had succeeded in completely disproving the Prohibitionists’ favorite arguments.

“There is not less drunkenness in the Republic, but more. There is not less crime, but more. There is not less insanity, but more. The cost of government is not smaller, but vastly greater. Respect for law has not increased, but diminished.”

Support for Prohibition eroded among voters and politicians. Against expectations, many women also supported repeal, again because of seeing the destructiveness of the law itself.

Even John D. Rockefeller Jr., a lifelong nondrinker who had contributed hundreds of thousands of dollars toward getting Prohibition passed, switched sides after seeing the widespread problems it caused.

1932: Democrats, including their presidential candidate, Franklin D. Roosevelt, campaigned on repealing the Eighteenth Amendment to the United States Constitution.

The next year, both chambers of Congress and the requisite number of State legislatures ratified the Twenty-first Amendment, which repealed Prohibition.

December 5, 1933: All Federal Prohibition laws were officially repealed.

Please note: Prohibition was both passed and repealed by amending the Constitution, which can be done in only one of two ways:

  1. Two-thirds of the House of Representatives, two-thirds of the Senate and three-fourths of the various State legislatures must all agree to vote for the amendment. This is the method used to both pass and repeal Prohibition and is, in fact, the only one used to date.
  2. Congress can be by-passed if two-thirds of the State legislatures call for a Constitutional Convention, then amendments proposed at the Convention are ratified by three-fourths of the State legislatures.

Five years ago, Barack Obama assured us:

“I know more about policies on any particular issue than my policy directors.”

Well, apart from his signature health-care policy. That’s a mystery to him.

“I was not informed directly that the website would not be working,” he told us.

The buck stops with something called “the executive branch,” which is apparently nothing to do with him. As evidence that he was entirely out of the loop, he offered this:

“Had I been I informed, I wouldn’t be going out saying, ‘Boy, this is going to be great.’ You know, I’m accused of a lot of things, but I don’t think I’m stupid enough to go around saying, ‘This is going to be like shopping on Amazon or Travelocity,’ a week before the website opens, if I thought that it wasn’t going to work.”

Ooooo-kay. So, if I follow correctly,

  • the smartest president ever is not smart enough to ensure that his website works;
  • he’s not smart enough to inquire of others as to whether his website works;
  • he’s not smart enough to check that his website works before he goes out and tells people what a great website experience they’re in for.

But he is smart enough to know that he’s not stupid enough to go around bragging about how well it works if he’d already been informed that it doesn’t work.

So he’s smart enough to know that if he’d known what he didn’t know he’d know enough not to let it be known that he knew nothing.

The country’s in the very best of hands.

IMHO, if you want to find a CLEAN politician in Washington, D.C., just look for the ones the MSM and both Democrat and Republican party big wigs condemn as “extremists” and hang out to dry whenever a vote truly matters.

Republicans want to cut food stamp funding. Democrats will be sure to weep, wail and gnash their teeth about evil Republicans who want children and old people to starve.

As you listen to the theater, remember that just last week, Obama was all set to FREEZE November food stamp payments if he didn’t get his debt limit increased. Also remember this one … in 2010, Democrats STOLE food stamp funds to pay off their big union campaign donors.

I spent most of the morning doing a stress test at the hospital. When I came home I turned on the computer to catch up on the day’s events-I wish I hadn’t.

SENATE GOP SELLS OUT TO THE DEMOCRATS,WILL BYPASS HOUSE. BOEHNER WILL FOREGO HASTERT RULE AND PASS WITH MOSTLY DEMOCRAT VOTES.

 

The only thing they ‘won’ was income verification…which was the law anyway.
