End of Another Error

The Obama administration said that Title IX anti-discrimination protections should mean that transgender students had access to facilities of the gender with which they identified, like single-sex locker rooms and bathrooms.

In August, the Northern District of Texas federal court placed an injunction on the order and the Obama administration appealed.

On Friday, the Trump administration announced that it was dropping the appeal, saying the order “radically distorted” Title IX, which “was intended to equalize educational opportunities for women.”

The Media Collect Their First Scalp – UPDATED

The trouble with the Trump Administration is that they’re bad liars and even worse at covering it up. The democrats have it down to a science. None of them ever pays a price for the lying, the bribes, the corruption, and the double dealing. When they must, they yawn and moan: ‘I take full responsibility.’ Which means the press drops the issue and it’s back to business as usual. That in no way excuses Gen. Flynn lying to Vice President Pence about communicating with Russia and putting the VP in an awkward position. He resigned today, being a man of honor and wanting to bring no more shame on the Commander-in-Chief.

Make no mistake, he was sabotaged by leaks to the press from inside the intelligence community. These are career operatives always looking out for #1. Their leaks to the media are reminiscent of the infamous “Deep Throat,” who made liberal icons of Woodward and Bernstein. Their brethren in leftist hackdom are lusting after a scalp of their own.

About the “Nutty 9th”

Trump’s immigration order was banned by the 9th Circuit Court of Appeals, the SLOWEST of the 12 federal appeals courts. 

Though they typically take 15 months to hand down a decision, they somehow or other found time to squeeze in an immediate judgment against Trump’s executive order, maybe because eighteen of the court’s 25 active judges have been appointed by Democrats.

Former President Barack Obama appointed seven of them.

The 9th is unaffectionately known as the “nutty 9th”, because it is the most liberal and MOST REVERSED court in the nation.

An average of EIGHTY PERCENT of its decisions get OVERTURNED!

Republicans in both House and Senate have introduced similar (though slightly different) bills to reduce the size of the 9th and create a new 13th circuit court.  

Even if the 9th weren’t a ridiculous clown show of judicial activism, its jurisdiction needs to be pared down.  Eleven of them cover 80% of the population; the 9th covers 20%That’s just dumb and it needs to be rectified.

“The President has a lot of tools that the Congress has given him. One of the tools is the statute that he read yesterday, which we’ve all been talking about, which was exercised by President Carter and by President Obama, a blanket ban on immigrants from given places. The statute specifically says ‘the President on his own by proclamation,’ meaning he doesn’t have to consult with anybody else, ‘can make this decision.’ The decision to ban is not reviewable; it’s not justiciable.  Judges are incapable of second-guessing the President on it.”

Be Careful What You Wish For

One thing is clear. If the miserable slug from Nevada had not undone the filibuster in his zeal to get rafts of Obama judicial nominees, President Trump would not have a single cabinet member confirmed. Not a one.

  • Education Secretary: Betsy DeVos confirmed on a voted 51-50.
  • Attorney General: Jeff Sessions confirmed 52-47.
  • HHS Secretary: Tom Price confirmed 52-47.

To the surprise of absolutely no one, the injunction against the travel ban was upheld by the ninth circuit by a margin of 3-0.

Sessions had not yet been confirmed and the lawyers from the Justice Department who argued the case were holdovers from the Obama regime, so there was no real motivation to put much effort in their argument.

It is paramount that the Republicans get Neil Gorsuch confirmed to SCOTUS before the case is heard there. With a 4-4 split, if Kennedy sides with the originalists in deciding such action is within the purview of presidential power, the lower court ruling would stand. It will eventually be reinstated, but the when is unknown.

Dianne Feinstein Regrets Filibuster Reform as Senate Confirms More Trump Cabinet Picks
The Senate confirmed Rex Tillerson as Secretary of State with 56 votes; Jeff Sessions as Attorney General with 52 votes; and Betsy DeVos, who barely reached a majority of 51 votes without Vice President Mike Pence’s deciding vote to confirm her as Secretary of Education.

“As we look back, it may well have been better to not have changed the rules.”

Some Democrats remain unapologetic about the decision, however. Sen. Tim Kaine (D-Va.) told IJR he maintains that filibuster reform was essential:

“At the time I thought, ‘I might serve here with a Republican president and I might serve here when there’s a Republican majority.’  We were in a situation where positions that were really important were going vacant for years at a time.”

In response, Washington Gov. Jay Inslee, a Democrat who leads one of the states that challenged the ban, said: “Mr. President, we just saw you in court, and we beat you.”

The court battle is far from over. An appeal to the U.S. Supreme Court seems likely. That could put the decision in the hands of a divided court that has a vacancy.

Trump’s nominee, Neil Gorsuch, is unlikely to be confirmed in time to take part in any consideration of the ban, which was set to expire in 90 days unless it is changed.

Senate Democrats flew a restaurant worker all the way from Los Angeles to Washington on Thursday, to help them portray President Trump’s nominee for Labor Secretary not only as “unqualified,” but also as someone who steals money from workers; looks the other way when workers are sexually harassed; forces people to work for free; punishes them for calling in sick; and fights against raising the minimum wage.

“Puzder called us the worst of the worst and the bottom of the pool. I work myself to the bone just to survive. Why would we want someone who think so little of workers in charge of policies that could impact all of us?” the allegedly victimized woman asked.

On Thursday, Schumer told the same news conference, “It’s disgraceful to put ‘secretary of labor’ and ‘Puzder’ in the same sentence, given his views.”

Schumer said Democrats hope they can force the withdrawal of Puzder’s nomination, but even if they can’t, it’s all about laying the groundwork to stymie the Trump administration:

Liberal Ninth Circuit Court Is Overturned in Recent Years 80% of Time

The Ninth Circuit Court ruled against President Trump and continued to block his travel ban on Thursday.  The Ninth Circuit is the most liberal court in the country — and is the most reversed court in the country.

2010, perhaps seeking to reclaim its position at the top of the heap, the Ninth Circuit was reversed a startling 19 times (79 percent), three times as many reversals as most circuits had cases before the Supreme Court. The same pattern continued in the 2011 (71 percent) and 2012 terms (86 percent), when the Ninth Circuit was reversed more than twice as many times as most circuits had cases before the Court.

Two stunning examples

Judges are supposed to interpret the law according to precedents, not legislate or indulge in social engineering from the bench.  Here are two stunning examples of the latter from Dan Bongino’s Facebook:

1) When the Supreme Court ruled that the Obamacare penalty was a tax, they ignored Barack Obama himself who had vigorously argued in a nationally televised interview that it was not a tax. So, when it’s a liberal agenda item, the President’s words do not matter.

But, in arguing against the Trump Executive Order on immigration, the left and their judicial allies insist on bringing up Trump’s campaign language about a “Muslim ban” even though the Executive Order says nothing about a Muslim ban. So, when it’s a conservative agenda item, the President’s words do matter.

2) When Arizona passed an illegal immigration law which mimicked federal law, the Supreme Court struck down portions of the law with Justice Kennedy saying , “The State may not pursue (immigration) policies that undermine federal law.”

But, now that liberals dislike the Trump Executive Order and the federal immigration law it is based on, they are vigorously arguing for a state role in national immigration policy and the courts seem more than happy to agree.

Betsy DeVos confirmed as Trump’s Secretary of Education

As expected, the vote was 50-50, triggering the remedy provided for in the Constitution, which is for the Vice President to break the tie.

  • “The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided.”

Sen Chuck Schumer (D-NY) played his role in the on-going Democrats in La-La Land farce by tweeting:

That’s definitely not ridiculous or anything.

  1. It’s not his cabinet. It’s President Trump’s.
  2. It’s not “rigged” to follow the procedures set out in the Constitution.
  3. It’s not “rigged” for the VP to vote for the person he wants.

Senator Schumer, you make me ashamed to be among your constituents.

Rep. Maxine Waters (D-CA) wants to impeach Donald Trump as soon as possible.

  • So sorry, Maxine. You can’t impeach a president just because you don’t like him.

“I think that he is leading himself into that kind of position where folks will begin to ask, ‘What are we going to do?'” Waters said. “And the answer is going to be: eventually we’ve got to do something about him.”

  • Like re-elect him to four more years maybe?

“He [President Trump] supplied the bombs that killed innocent children and families in Aleppo.”

  • Aleppo was bombed by Russia last fall, long before Trump was inaugurated.  If any American president “supplied” those bombs, it was Obama.

“And the fact that he [President Trump] is wrapping his arms around Putin while Putin is continuing to advance into Korea.”

  • I’ve seen no evidence that Trump and Putin are getting cozy.  Plus, you know, Putin didn’t invade “Korea.” It was Crimea.

There are those who say that the Democrat Party’s leadership is “out of touch.”  Noooooooo, really?

Feb 6, 2017:  House Minority Leader Nancy Pelosi (D., Calif.) said, “While it’s only been a couple of weeks since the inauguration, we’ve seen nothing that we can work, that I can work with President Bush on.”

The Self-Beclowning Continues

It is an unfortunate state of affairs that the alt-left is so consumed with obstructing progress that they fail to see that, for all but those who suffer similar dementia, they look like a bunch of braying jackasses raising a racket and crapping on the floor of the building where they have to ‘work’, or some similar facsimile.

They are, at the time of this posting, in the middle of a 24 hour conniption fit, trying to convince one more RINO to join them in doing the teachers union’s bidding. They already have Murkowski from Alaska and the Maine Pain Susan Collins. That makes the vote 50-50, with Vice President Pence tasked with casting the tie-breaking vote on a cabinet nominee for the first time in history. The end game is to delay seating the president’s cabinet as long as possible, just for pure meanness.

Trump’s travel ban to be argued Tuesday in S.F. federal court

Robart said the states had shown that the travel ban was causing financial hardship to their residents and to institutions such as state universities, and were likely to prove that Trump’s order discriminated against Muslims.

While Trump responded with tweets about the “so-called judge” and his “ridiculous” ruling, Justice Department lawyers argued that Robart had harmed the nation with “judicial second-guessing of the president’s national security determination.”

Democrats are speaking for 24 hours in last push against Betsy DeVos

Activists have targeted those Republicans who they believe have reservations about DeVos, particularly those from rural states, where alternatives to public schools — such as those promoted by DeVos — are few and far between. But other than Murkowski and Collins, no Republican has indicated that their support is shaky.

What’s really behind Democrats’ all-night anti-DeVos show

Again, the only real issue here is her ardent support for school choice, including public charter schools and voucher programs to help families choose qualified private or parochial schools for their kids. The unions (rightly) see choice as a potentially fatal threat to their vast power.

The all-nighter is also a bit of virtue-signaling to the Dems’ angry base that they’re really, really trying to Stop Trump At All Costs. (Maybe this will end the noisy rallies outside Chuck Schumer’s house?)

Virtually all Senate Democrats poised to vote against remaining Cabinet picks

The Senate is scheduled to continue confirming Trump’s Cabinet nominees this week, with a vote scheduled for Tuesday to approve Betsy DeVos, nominated to run the Education Department. Senators are poised to confirm Sen. Jeff Sessions (R-Ala.) to serve as the next attorney general by the end of the week.

But those votes are expected to happen with little or no Democratic support.  Only Sen. Joe Manchin III (D-W.Va.) has announced plans to support Sessions. As of Monday, no Democrat has announced support for DeVos, Rep. Tom Price (R-Ga.), nominated to lead Health and Human Services, or Steven T. Mnuchin, nominated as treasury secretary. They all are scheduled for up-or-down votes in the coming days.

The Year of the Comeback

October: The Chicago Cubs come back from a 3 to 1 deficit to win their first championship in 108 years.
November: Donald Trump beats the odds and stuns the world by defeating the presumed next president and doing it handily.
February: The New England Patriots fell behind 28-3 before fighting back and ultimately winning Super Bowl 51 in stunning fashion.
There were many storylines to follow. What would Lady Gaga do? How disgusting and blatantly political would the commercials be? Would there be high drama when Roger Goodell, the NFL commissioner, handed MVP Tom Brady the trophy after suspending him for the first four games as a result of Deflategate? Turns out Gaga played the halftime show without the sermon on ‘diversity’, Goodell makes $41 million a year, so he couldn’t care less, and the commercials without political statements were precious and few.

Speaking of which, a singer who was with not one but two one-hit wonders passed away 4 years after suffering a brain aneurism. Sonny Geraci scored his first hit with The Outsiders and a song called ‘Time Won’t Let Me.’ It was one of the very first albums I got and I wore it out on my old record player.

He later hit #1 again with Climax and the tune played at a lot of weddings: ‘Precious and Few’.
His hair was considerably longer by then. Love the bell bottom pants.

That had nothing to do with anything, I just wanted to do it.
