Two stunning examples

Judges are supposed to interpret the law according to precedents, not legislate or indulge in social engineering from the bench.  Here are two stunning examples of the latter from Dan Bongino’s Facebook:

1) When the Supreme Court ruled that the Obamacare penalty was a tax, they ignored Barack Obama himself who had vigorously argued in a nationally televised interview that it was not a tax. So, when it’s a liberal agenda item, the President’s words do not matter.

But, in arguing against the Trump Executive Order on immigration, the left and their judicial allies insist on bringing up Trump’s campaign language about a “Muslim ban” even though the Executive Order says nothing about a Muslim ban. So, when it’s a conservative agenda item, the President’s words do matter.

2) When Arizona passed an illegal immigration law which mimicked federal law, the Supreme Court struck down portions of the law with Justice Kennedy saying , “The State may not pursue (immigration) policies that undermine federal law.”

But, now that liberals dislike the Trump Executive Order and the federal immigration law it is based on, they are vigorously arguing for a state role in national immigration policy and the courts seem more than happy to agree.

They voted FOR Gorsuch in 2006

Democrats are preparing for all out war against President Trump’s Supreme Court nominee Neil Gorsuch and Minority Leader Chuck Schumer is leading the way.

But when Gorsuch was nominated to serve on the U.S. Court of Appeals by President George W. Bush in 2006, he was confirmed unanimously (95-0) in the Senate.

This Is Already Tiresome

Tucker Carlson was interviewing some blow-dried Ken-doll wannabe congresspunk from California last night and this clown would not stray from his talking points no matter what Carlson asked him. Thankfully, the network panned to a shot of the daily protests outside the Supreme Court.

I may be the only person in America who noticed some idiot holding a pre-printed sign that had the word “OPPOSE” at the top with a blank white space underneath it. After Trump made his nomination known, they printed “GORSUCH” in the blank space with a Sharpie. They were prepared to protest whoever the president picked, even if it was the Wizard of Oz.

As with their shameless behavior regarding the Cabinet nominees, they are going to fight this appointment tooth and nail. In the end they will likely lose, although it is a case of one originalist replacing another. The all-out war will occur if one of the leftists, probably the Notorious RBG retires from the bench. She has already stated she’s not going anywhere until there is a Democrat president to replace her.

Think: The Dems wheeling the late and unlamented Robert C. Byrd on a hospital gurney for an important vote, or Tim Johnson who suffered a brain aneurism and was absent for almost two years and never replaced, since he represented North Dakota, which would have elected a Republican in his stead.

They’re playing a dangerous and potentially disastrous game. Tingles Matthews claimed that not a single Democrat senator will vote to confirm. I disagree. There are 12 senators from red states up for re-election in 2018. The playbook says there will be 5 or 6 democrats who will be given permission to confirm as long as there are not the requisite 60 votes to uphold the filibuster. They all sing from the same hymnal: ‘Lord, save my ass.’

[CtH: I am still puzzling over why RBG didn’t retire when Obama was in office.  She’s older than dirt and is unlikely to survive the 8 years Trump could be in office.  Probably she, like the rest of the Ds, thought Hillary was a shoe-in.  Oops!  Cuz replacing Scalia with Gorsuch is no biggie.  Replacing Ginsburg with someone the Republicans like will tip the bench back toward traditional values and put Roe v. Wade seriously at risk.  We can pray!]

Chris Matthews: Gorsuch Vote Will Go To A Filibuster; Democrats Will Not Vote For Him, “Not A One”

“I think this is going to come down to a sad denouement,” Matthews said Tuesday night. “I think it’s going to take 60 votes to get this approved and I think the Republicans will have their rank-and-file 52 votes will be there. But I don’t think the Democrats are going to give them a single vote which mean this will go to a filibuster.”

Chris Matthews on Democrats who vote for Gorsuch:  He will “be on that court for 30 years … they will have to answer for this guy.”

And since, according to Matthews, no Dems will vote to confirm, the nomination will fall short of the required 60 votes.

This Insurrectionist disagrees. No matter how much McConnell reveres Senate tradition, he will not let such a qualified jurist, and Trump’s first Court nominee, go down to ignominious defeat. If push comes to shove, I predict that McConnell will invoke the nuclear option, and Gorsuch will be confirmed on a simple-majority vote.

IOW, THE DEMOCRATS MUST CHOOSE WHAT HILL THEY WANT TO DIE ON

GOP changes Senate rules, approves Trump cabinet picks
A Democratic boycott couldn’t prevent President Trump’s cabinet picks for Treasury and health from gaining approval by the Senate Finance Committee.

The Republican-led committee changed its rules to allow it to operate without the boycotting Democrats and approve Steve Mnuchin for the Treasury post and Tom Price as Health and Human Services secretary.

The next step will be for the pair to be confirmed by the entire Senate.

Wake Me When It’s Over

There are days when it is difficult in the extreme to find the motivation to park in front of this machine and begin my daily sojourn into the belly of the political beast. There was a time a couple years ago when there was a lot of discussion and back and forth on this blog but I suspect most have gotten bored or just lost interest and moved on. Many days it is only through a sense of indebtedness to what this has meant to me keeps me doing it.

As you all are well aware, Obama gave his farewell ‘F*ck you, America’ speech last night before 20,000 adoring, brain-dead acolytes at McCormack Center. They hung on every lie that spilled from his purple lips. He even mustered up a few tears when he talked about his baby mama and his two jaded offspring. I could fill an entire post with articles about this exercise in sophistry, but I seriously doubt you care, and frankly, I don’t either.

The Supreme Court has turned away former Minnesota Gov. Jesse Ventura’s bid for reinstatement of a $1.8 million verdict in his defamation case against the estate of slain Navy SEAL and “American Sniper” author Chris Kyle.

Delusional to the Bitter End

Barack Obama has 22 more days to wreak as much havoc as he possibly can. A man of character would be helping his successor with the transition of power. Not him. He came into office with a gigantic chip on his shoulder and a fire in his belly to inflict as much pain as he could because of America’s wealth and power. His eight-year reign of terror has been a non-stop crusade to weaken the US, embarrass us internationally, and crush the American spirit through taxes and executive orders when a republican majority in the House and Senate would shun complicity in our destruction. He has packed the courts, declared huge swaths of land off limits for energy exploration, released more than a thousand felons, and is desperately trying to empty Gitmo before he leaves. It is certain he will issue many more pardons on his last day and will not go quietly. The Enslaved Press will allow him to pontificate about everything Trump does. He’s already convinced himself if the economy improves, he did that. People like him are so far out of touch with reality they are beyond rational thought.

Obama expands environmental legacy with 2 Western monuments
The Bears Ears National Monument in Utah will cover 1.35 million acres in the Four Corners region, the White House announced Wednesday. In a victory for Native American tribes and conservationists, the designation protects land that is considered sacred and is home to an estimated 100,000 archaeological sites, including ancient cliff dwellings.
In Nevada, a 300,000-acre Gold Butte National Monument outside Las Vegas would protect a scenic and ecologically fragile area near where rancher Cliven Bundy led an armed standoff with government agents in 2014. It includes rock art, artifacts, rare fossils and recently discovered dinosaur tracks.
The White House and conservationists said both sites were at risk of looting and vandalism.

Obama Admin Rushes To Resettle Refugees During Last Days In Office
From the start of Fiscal Year 2017, Oct. 1 2016 through Dec. 27, a total of 25,671 refugees have been resettled in the United States — little over 290 refugees per day. During that same time period in 2015, 13,791 refugees were resettled, almost 157 per day. The Obama administration resettled nearly 85,000 refugees in FY2016 and the White House is on pace to resettle nearly double that amount.

That leaves one potentially big stick in Obama’s rapidly shrinking arsenal: recess appointments of judges to fill scores of federal-bench vacancies — up to and including Antonin Scalia’s seat on the Supreme Court.
There’s a problem with this, which is that the Supreme Court ruled in 2014 that Obama had no right to make recess appointments to the Labor Relations Board (in 2012) while the Senate was in pro forma session. But Kilgore suggests there is a way around this. In involves making the appointments in the seconds between the end of one Senate session and the beginning of the next one:

The passage of Obamacare via reconciliation, the decision to use the nuclear option, the Senate Majority leaders lies about Mitt Romney’s taxes, the aforementioned “recess appointments” to the Labor Relations Board, the President’s unprecedented expansion of prosecutorial discretion under DACA, his kill list and use of drones against U.S. citizens, the payment of subsidies to insurers despite a requirement to make payments to the Treasury. Not to mention the Democrat-led attempts to request a blanket pardon for “dreamers,” to rally faithless electors to attempt to change the outcome of the election and to demand a special classified briefing for electors—all of which took place in the last month. Granted those last three didn’t work out but not for lack of trying.

Emails show how Reid’s ‘nuclear option’ helped Obama regulate Internet

You may recall that earlier this year, about three years after the nuclear option helped Obama establish a liberal majority on the D.C. Circuit, a three-judge panel on the case decided a key case on FCC regulation of the Internet.
Democratic appointees at the FCC had been trying to regulate the Internet essentially like a utility, but up to that point they had been blocked in the D.C. Circuit. But this time, the pool of judges from which the panel on the case was drawn was a lot more favorable. And the result in this case was a 2-1 decision in favor of the FCC position.

Two Faced Obama

Technically, the gas and oil ban is not an executive order, because a little-known provision in the Outer Continental Shelf Lands Act of 1953 says the president “may, from time to time, withdraw” federal waters that are not already leased from oil and gas development.

Mmmmmmmmm … call me crazy, but I don’t think indefinitely removing millions of acres of federal waters from oil and gas development quite fits the spirit of “from time to time.”

But that’s Obama all over.  Although he has not issued as many executive orders as former Presidents Bill Clinton and George W. Bush, he has used them to do a lot more “ruling from the throne” with his famous pen.

He explained why in the same interview where he said Trump should go to the trouble to pass legislation.  See, HE only switched from getting bills passed to ruling by fiat because the stupid old voters went and stole his congressional majorities.

“In my first two years I wasn’t relying on executive powers because I had big majorities in the Congress and we were able to get bills done, get bills passed,” Obama said.

One of Obama’s sweeping, non-legislative, “I’ve got a pen” executive orders would have allowed millions of illegal immigrants to be shielded from deportations and apply for work authorization programs. The Supreme Court blocked it earlier this year.

Trump has said his use of executive orders will “serve a much better purpose” than what Obama’s done.

Electors only “act by authority of the state.”

The guest on this Tucker Carlson video says the Constitution gives electors the right to vote their conscience.  He’s 100% wrong.

Law Newz explains:

“In the seminal decision of Ray v. Blair, the Supreme Court made clear electors act at the privilege of the state that empowers them, and do NOT enjoy any special right to vote as they please.

“Article II, section 1 of the Constitution gives states the rights to select their electors as they please, including a right to require party and candidate loyalty.”
