The Obamacare Abortion Fee

It is obvious between this blatant funding of the abortion industry and the finalized HHS rule that requires all plans to cover birth control and abortifacient drugs that the DNC, the Obama administration and the pro-aborts have ZERO commitment to protecting our First Amendment rights.

If we lose in the fall and Obamacare gets fully enacted, it will only be a matter of months before all policies will be required to cover abortion and all Americans will be required to pay $1 a month to fund the abortion industry … which in turn funds the Democrats at every level of government.

Obama DOJ retreats on 2 FACE prosecutions

Last week, in an abrupt about-face, the DOJ dismissed the Pine case, which they had earlier appealed. Not only was the case dismissed, the department also agreed to pay $120,000 in attorney fees.

Prior to the DOJ’s appeal, Florida resident Mary Susan Pine thought her legal battles were over when the lower court judge dismissed all charges against her. The dismissal was based on the complete lack of evidence presented by Attorney General Eric Holder.

In dismissing the charges, Judge Ryskamp openly chastised Holder, questioning his motives for bringing the charges in the first place.

The judge’s comments raised the issue of whether there might have been a conspiracy between the government and the abortion clinic to violate Ms. Pine’s free speech rights.

Following this rebuff, the DOJ promptly filed an appeal, which has now been dismissed. Finally, Ms. Pine has been vindicated.

The dismissal of the Pine case came on the heels of the DOJ dismissing all charges against Ken Scott, another peaceful pro-life advocate being unjustly prosecuted under FACE.

The David Coppedge Trial

David Coppedge is suing his former employer, NASA’s Jet Propulsion Lab, for wrongful termination.

JPL’s legal team maintains that Intelligent Design (ID) had nothing to do with what happened to Coppedge at JPL.

Coppedge says it had everything to do with what happened.

On the legal plane it’s an employment discrimination case.

On the cultural plane, it’s a story about the extent to which the culture of Big Science forbids people in the world of science from freely debating the merits of certain ideas, creating an illusion of “consensus.”

JPL instructed Coppedge that he was forbidden from discussing ID with his colleagues.

No one had complained to Coppedge himself that he should stop talking about the subject with them — a request that, had it been made, he would have respected.

Instead, one colleague took it on herself to interpret polite offers of information on ID as “harassment,” and then to inform on Coppedge to their superiors.

The investigation that followed resulted in Coppedge’s demotion and finally termination.

JPL never forbid expressions of contempt for ID. In a variety of forums JPL employees hooted and jeered at ID while pumping for Darwin — a JPL-sponsored online discussion group, officially sponsored speaking events, with obnoxious stickers on their office doors, informal office conversations that would be impossible to catalogue and number — all with no negative repercussions.

JPL put a gag order only on Coppedge’s attempts to stand up to or rebut his colleagues. He was told specifically that “this type of discussion is appropriate in certain setting (i.e., a JPL Bible Study group or where an individuals requests an opinion).”

When Coppedge attempted to explain that Intelligent Design is science, not religion, he was told to shut up about his religion.

What the Constitution really says

This is quite a long and detailed article, so I have made an outline to help you decide if you want to spend the time reading it in more detail or just trust that I’ve hit the high points correctly. 🙂

Introduction

Federal judges do NOT have the right to interfere with State actions that may or may not constitute an establishment of religion.

The first clause of the 1st Amendment to the Constitution plainly states:

“Congress shall make no law respecting an establishment of religion.”

Since there can be no federal law on the subject, there appears to be no lawful basis for any element of the federal government – including the courts – to act in this area.

The 10th Amendment to the Constitution plainly states:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

This means that the power to make laws respecting an establishment of religion, having been explicitly withheld from the United States, is reserved to the States or to the people.

Taken together, the 1st and 10th Amendments clearly forbid federal judges from doing stuff like banning Ten Commandment displays on State property.

An erroneous premise

Federal judges and justices who do this stuff claim they have the right under the 14th Amendment:

“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

But, the 14th Amendment only restricts the legislative powers of the States where they deal with the rights of individual citizens.

And the first clause of the 1st Amendment deals with the rights of States, not individuals. Specifically, it reserves to each State the right to establish religion if a majority of the people of that State decide they want it.

Distinguishing rights of the people from individual rights

The first two clauses of the 1st Amendment are often treated as if they were one. This is incorrect.

The first clause — “Congress shall make no law respecting an establishment of religion” — designates a power of government that is reserved to the States. Congress is forbidden to address the subject at all.

The second clause — “or prohibiting the free exercise thereof” — deals with an action or set of actions (the free exercise of religion) that cannot be free unless they originate in individual choice. This clause allows for some federal action, but severely restricts the character of such action in favor of free exercise by individuals.

When federal judges ban a Ten Commandments monument on State property, they are violating both the clearly stated right of any State to establish religion and the right of individuals to freely exercise religion.

Parallel rights and actions

The assumption made by the judges that do this stuff is that the right of a State to do something somehow means individuals cannot do that thing.  That is wrong.

  • The government’s power to arm soldiers does not interfere with an individual’s right to arm himself.
  • The government’s power to establish schools does not interfere with an individual’s right to educate his kids at home or start a private school.
  • The government’s power to run a postal service does not interfere with an individuals right to operate a messenger service or set up a company like UPS.

The way the Constitution is written puts religion into the same kind of category — i.e., a matter of parallel individual and governmental possibilities.

Federal and State governments are both forbidden to coerce or prohibit individual choice and action in matters of religion.

The Federal government is further forbidden to get involved in any way with a constitutional majority’s decision within a State to express or support religious beliefs or values. The point of this was to secure the right of the people of the States to live under a State government that reflects their religious inclination.

Subverting the wisdom of the Founders

Federal judges who over-turn State laws on religion violate Article IV, Section 4 of the U.S. Constitution:

“The United States shall guarantee to every State in this Union a republican form of government.”

Federal judges who ban Ten Commandments displays on State property say the majority is not allowed to have that right, because some minority … possibly even one person … does not like the result of the vote.

But the Constitution protects the right of State majorities to choose on religious matters. Furthermore, it guarantees the rights of every individual in the losing minority to either stick around and try to convince fellow State citizens to change their votes or else move to some other State that upholds a value system they find more congenial.

What it does NOT do is allow federal judges to establish atheism as the official religion of the entire United States.

Unlawful usurpation and lawful resistance

These federal judges put the force of law and the punishment of force behind their orders. These are the very definition of what constitutes “establishment of religion.” Thus, while pretending to protect religious freedom, they actually destroy it.

Ordinarily, we have a duty to obey a court order. But where that order is unlawful, we may have a right or even a duty to disobey it. For example, if a federal judge orders the governor of a state to take actions that he conscientiously believes violates a fundamental and constitutionally protected right of the people of his State, that official is duty-bound to refuse the order.

An aside from CtH: For our military, this duty is encoded in the UCMJ; there is no “I was ordered to commit that crime” exemption allowed to American Soldiers. For Catholics, the moral rights to and limits on civil disobedience were defined by Pope Paul VI in section 74 of his 1965 encyclical Gaudium et Spes.

Judge Moore and the people of Alabama

The citizens of Alabama are justified in bringing suit against those State officials who carried out the judge’s unlawful order. But since the federal judiciary is the perpetrator, what chance do they have?

Judicial self-interest

Federal judges are human and humans are prone to look first to their own self-interest. Thus expanding their own power is likely to distract federal judges from the legal merits of the case.

The people and their representatives

This is why the U.S. Constitution did NOT make federal courts the ultimate judges of their own powers. That job rests with the Congress.

The right and duty of Congress

Congress must pass legislation that says “hands off” to federal courts on matters of State religious expression, such as the placement of a Ten Commandments monument on State property, which neither prevent nor coerce any individual’s practice of religion.

I read what Fancy Nancy had to say about Fluke’s “courage” in coming forward. There was this one bit about how horrible it was for one student who was told right at the pharmacy counter that her insurance didn’t cover birth control and she was OMG embarrassed and OMG had to walk away.

Well, crap. I guess we just should take a big black Magic Marker to that damn First Amendment thing about religious freedom and force that damn Catholic college to pay for her damn birth control. Right? I mean, What Would Jesus Do? LET her be EMBARRASSED?! It’s unspeakable. It’s outrageous. It can’t be allowed!

Senate says NO to Religious Liberty

Democrats created the HHS mandate requiring ALL health insurance plans to provide birth control, sterilization and the morning-after abortion pill, thus forcing Americans who oppose these activities to choose between paying for them, which would violate their consciences, or else stop offering health insurance to their employees.

Democrats and their lapdogs in the media lied about what the HHS mandate and the Blunt Amendment were about. Rather than admit the HHS mandate was a gross abrogation of our First Amendment rights, they claimed Catholics and Republicans were trying to deprive women of access to birth control, sterilization and the morning-after abortion pill.

States pushing back on HHS mandate

More than a dozen State Attorneys General have signed onto a letter warning the Obama administration they will sue if the HHS mandate isn’t dropped.

Memorable phrases from the letter:

We are deeply troubled by the unprecedented coercion of organizations and individuals to act contrary to their religious beliefs.

It conflicts with the most basic elements of the freedoms of religion, speech, and association, as provided under the First Amendment.

We believe it represents an impermissible violation of the Constitution’s First Amendment virtually unparalleled in American history.

The proposed mandate provides an insufficiently narrow exemption … To obtain the exemption, a religious organization would have to subject itself to the equivalent of a government “religious audit” … a great number of entities previously exempt from government regulations that run contrary to their religious beliefs would fail to qualify.

The choice for such organizations essentially becomes: provide and subsidize activity in contravention with core religious beliefs, eliminate employer-provided health coverage, or withdraw from public ministry.

Should this unconstitutional mandate be promulgated, we are prepared to vigorously oppose it in court.

CONCLUSION: The Administration’s latest health care mandate is an affront to the free exercise of religion and moral duty so long revered and protected in this country. In fact, in light of the Supreme Court’s decision in Hosanna-Tabor, one can only wonder at the thinking and motives behind the new rule. Clearly, little consideration was given to the legality of the mandate, suggesting that the motives were entirely political. But the Administration must have anticipated the vocal objections from the religious communities and simply decided that it didn’t much care whether those communities would cry foul; it was time for them to get in line with the health care program. The message sent by this new directive is loud and unmistakable: If you’re going to be an employer, an insurance provider, or participate in our health care system, you will play by the government’s rules and you will provide free contraception. Religious and conscientious objections will be disregarded and dismissed; fines will be assessed.

But the softer, subtler, and more ominous message in the Administration’s most recent sermon on health care is this: the religious will confine themselves to serving their own congregations, and “inculcating values” within the confines of their own communities. They will no longer educate the children, preach the Gospel to the poor, heal the brokenhearted, speak deliverance to the captives, give sight to the blind, or liberty to them that are bruised – because that’s what Government is anointed to do. Isn’t that what Jesus said?

But there is good news. Ultimately this new regulation will not stand. This mandate is far removed from the mainstream of First Amendment rulings, and badly misreads the Constitution and the important role that religious liberty plays in this country. It overlooks our founding history and relies on an erroneous view that caring acts by Americans are primarily secular acts, instead of the sacred acts of compassion and ministry that they often truly are. If the Congress doesn’t quickly overturn this regulation, the courts will.

Thank you all for your kind words and prayers.I could not ask for a more loving,caring group of people to call my friends.Chrissy,I was surprised to hear we’ve had the same experience.I’ll definitely use the Nature’s Sunshine HS-2,if you can tell me where to find it.

While I was doing transport,I worked one Saturday even though I was really sick.When I got back to the office I called DW and told her when I got home she was taking me to the emergency room.I had a fever of 102 and an x-ray showed I had pneumonia in my left lung.The doctor said my blood oxygen level was 72 and by law I couldn’t leave until it was at least 90.I spent over an hour breathing albuterol through a nebulizer.He said I probably have sleep apnea,but my body has adjusted to the low oxygen level.

When you start thinking death can come quickly it puts things in perspective.I consider myself fortunate to have grown up in a slower,more innocent time in America.Life was far more family-oriented and less cynical.Dad went to work,Mom took care of the house and she was always there when you got home from school.When mom said: ‘wait till your dad gets home’ it really meant something.

When somebody fom the neighborhood or from church suffered a hardship we didn’t whine about the government helping out.We offered anything we had to help because they would surely do the same.

Between my junior and senior year in high school one of my classmates got pregnant and her parents had to take her out of school.Now they have daycare for student mothers because it’s so commonplace.

We went from pickup baseball games at the park and reading 10 cent comic books to who had the fastest car or the loudest 8 track tape player.We cruised the local root beer stands and parked in the back row with our girl friends at the drive-in movie theater.I won’t go into details–I’m a gentleman.

I remember how things were and see how they are now and I can’t help but feel sad for those who will never know what it was like to have pride in who you were,where you lived,what you did and found satisfaction in never asking anybody for anything.

Make no mistake,Giffords is as far left as they come.Maybe Obama arranged this as a make-good since he threw her astronaut husband out of work when he cancelled the space program.Whatever the reason,I can think of a lot of people who would deserve this honor far more than this woman.
